Pricing (Effective
1/1/2005): |
- Network workstation and standalone computer hardware, software, and
accessory setup, installation, maintenance, troubleshooting, repair; and general
consulting services (on-site, off-site, telephone-based, or online/dial-in) - $75.00 per
man-hour in 15-minute increments.
Network server and
infrastructure hardware and software setup, installation, maintenance, troubleshooting,
repair; and all programming and web development services (on site, off-site,
telephone-based, or online/dial-in) - $90.00 per man-hour in 15-minute increments.
Travel will be billed at an hourly rate of $36.00 per hour in 10-minute
increments, portal-to-portal from our Charleston office.
Services performed outside our normal business hours (8:00 a.m. to 5:00
p.m. Monday through Friday, excluding major holidays) at the explicit request of our
customers will be billed at one and one-half times the applicable service fee(s). Services
performed outside our normal business hours for our scheduling convenience will NOT be
charged this after-hours premium.

Terms Of Sale: |
- All sales are final and all products are sold as-is subject to the
warranty policies contained within this document. The customer is responsible for
determining if a product will perform as desired to meet the customers needs. This document supersedes any oral changes
or agreements. Any changes or addendum to these policies must be made in writing and
signed by both an authorized representative of Logical Operators, Inc. and the customer.
Logical Operators, Inc. reserves the right to refuse future sales or non-warranty service
to any customer for any reason.

Return Policy: |
- All product returns are subject to the warranty policies contained within
this document. Products may be returned in exchange
for like or similar products only. Products may be returned for a refund only at our discretion
and may be subject to a restocking fee equal to 15% of the
original sales price. All products returned for refund must be accompanied by a valid
Logical Operators, Inc. invoice or receipt and must be complete and unused in original
packaging and in resalable condition.

Performance Of Service: |
- The customer agrees that all services
performed have been performed to the customer’s satisfaction as
requested and are final and complete. The customer is
responsible for ensuring that any affected equipment is sufficiently protected in such a
way as to secure the value of the service performed. This may include, but is not limited
to, following operating instructions given by our personnel; performing data backups;
providing physical security for equipment; protecting equipment from damaging exposure to
water, electricity, or fire; and ensuring that any future third-party service does not
alter the results of service provided by Logical Operators, Inc.

Terms Of Payment &
Collection: |
- The customer agrees to promptly remit payment for the total of all
services performed and products received. The customer is responsible for the payment of
any applicable taxes and/or tariffs levied upon purchases or the usage of products
purchased. Unless otherwise quoted in writing, charges for products do NOT include sales
tax, shipping, delivery, installation, configuration, or maintenance fees. A twenty-five
dollar ($25.00 US) service charge will be applied for any returned customer checks. In the
event that a method of payment does not satisfy all charges, the remaining balance plus
any fees incurred by us during collection attempts will be invoiced to the customer as a
credit purchase with credit extended by Logical Operators, Inc. to the customer. For
credit purchases, a 1.5% late-payment fee will be applied each month to the outstanding
balance of any amount remaining unpaid after the initial time limit extended for credit,
which begins with the final delivery date of products and/or services. Failure to remit
full payment for any invoice may result in our refusal to provide additional service,
maintenance, or warranty coverage for any equipment for which Logical Operators, Inc. has
not received full payment. Furthermore, failure to remit full payment may result in our
refusal to provide additional service or maintenance for any of the customers
equipment at any of the customers locations. In the event that Logical Operators,
Inc. must seek collection assistance and/or legal assistance to obtain payment, the
customer agrees to bear all collection costs and/or legal fees necessary to collect said
payment.

Product Warranties: |
- Logical Operators, Inc. honors the original manufacturer warranties of
any new products purchased from us subject to the limitations and exclusions of the
manufacturers warranty and the limitations and exclusions
listed throughout
this document. Previously used or reconditioned products are purchased with either no
warranty or a limited warranty defined separately at the time of sale. We are not
responsible for covering any warranty for any product not originally purchased from us.
Problems arising from faulty installation and/or incorrect configuration and/or incorrect
usage are not covered under warranty. Under no circumstances will Logical Operators, Inc.
or its vendors be responsible for any incidental or consequential damages which may occur
during use of a purchased product or as a result of a products failure to perform.
In all cases, the customers sole remedy for a product failure is limited to a
replacement product or, at our discretion, a refund not to exceed the original purchase
price of the product. In all cases, warranty repair
and/or replacement is limited only to the faulty hardware device and does
not include installation, reinstallation, or configuration of operating
systems or other software.
In
some instances, factory service may be required to properly repair a product. The customer
is responsible for returning the product, properly packaged in its original container, or
equivalent, to either Logical Operators, Inc. or our designee. Any postage, insurance,
or shipping cost incurred in presenting or sending the product for service is the sole
responsibility of the customer.
During the stated warranty period, Logical Operators, Inc. will repair, free of charge,
any defects in material or workmanship which occur during normal use. Repair parts and
replacement products shall be furnished at our (or
our vendors) discretion on
an exchange basis and shall be either new or reconditioned. All replaced parts and
products shall become the property of either Logical Operators, Inc. or
our vendor.
Under this warranty, coverage will only be granted if, in our (or the
manufacturers) opinion, the defect or malfunction was NOT caused by:
- improper packing during return shipment to us;
- disasters such as floods, fires, winds, earthquakes, or lightning;
- failure to provide the proper installation environment;
- peripherals or unauthorized attachments;
- service by an unauthorized service center;
- any other type of abuse, misuse, or neglect;
- or where the serial number or rating label has been removed, defaced, or altered.

Custom Computer Systems Warranty: |
- Custom computer
systems are subject to
the special warranty policies listed in this section as well as the
general product warranty policies specified elsewhere in this document.
Logical Operators, Inc. warrants the computer system's
CPU chip and RAM to be free from defects in material and/or workmanship
for a period of three (3)
years from the date of original purchase. Parts and labor for all other
components are covered for a period of three (3) years
(unless otherwise stated) from the date of original purchase.
In cases where the manufacturer’s warranty
exceeds three (3) years, the manufacturer’s warranty will be honored. This
warranty applies to original purchases made in Canada or the United States
of America. This warranty is not transferable from the original point of
sale.

Your Legal Rights: |
- Limitations on length of an implied warranty and exclusions or
limitations of incidental or consequential damages for consumer products are prohibited in
some states. Therefore, the aforementioned limitations and exclusions may not apply to
you. This warranty gives you specific legal rights and you may also have other rights
which vary from state to state.
